ColorMuse Pro Terms of Service

1. Acceptance of Terms

These Terms ("Terms") govern your use of ColorMuse Pro ("the App"), operated by You&Me Solutions ("we," "us," or "our").

By accessing or using the App, you accept and agree to these Terms. If you do not agree, please do not use the App.

2. Description of Service

ColorMuse Pro is designed for painting professionals to manage customers, projects, and finances. Features include:

• CRM: Customer database, contact and project organization
• Project Management: Task tracking, scheduling, progress updates
• Invoicing: Custom PDF invoices, labor and material cost tracking
• Color Management: Track paint colors, brand codes, and notes
• AI Color Analysis (Premium): Identify and match colors from photos (for reference only)
• Data Recovery (Premium): Restore soft-deleted data across your devices
• Financial Tracking: Labor hours, expenses, and automatic totals
• Multi-Language: English, Spanish, Traditional Chinese, Simplified Chinese, Japanese

3. User Eligibility

You must be at least 17 years old to use the App for legitimate business purposes. By using ColorMuse Pro, you confirm:

• You're at least 17 years old
• You have legal capacity to agree to these Terms
• You will use the App responsibly and lawfully
• Your account information is accurate and current

4. User Accounts and Security

4.1 Account Creation

Create an account via Apple OAuth, Google OAuth, or Firebase email/password authentication.

4.2 Your Responsibilities

• Keep your login credentials secure
• Notify us immediately of any unauthorized use
• Maintain accurate account details
• Understand that we do not provide automatic backup or restore services; your data is stored under Firebase’s default storage permissions.

Limitation of Liability: To the fullest extent permitted by law, we are not liable for any data loss, damages, or costs arising from your failure to secure your account or maintain your own backups.

6. Acceptable Use

Use the App only for lawful, authorized activities. You must not:

• Violate any laws or regulations
• Upload malicious code or harmful content
• Interfere with App functionality or security
• Share your account with unauthorized users
• Impersonate others

7. Intellectual Property

7.1 Our Rights

All trademarks, logos, and code are owned by You&Me Solutions. Protected by IP law.

7.2 Your Data

You retain ownership of all content you upload. You grant us permission to store and process it to provide the service.

8. Data Responsibility

8.2 Appropriate Data

The App is intended for business-related data, such as customer contacts, project specs, paint details, labor and material costs, and invoices.

8.3 Storage & Backup

We use Firebase’s default storage permissions; you are solely responsible for exporting and backing up your critical data. We do not provide any automatic backup or restore functionality beyond the soft-delete recovery feature.

9. Privacy

Your data is governed by our Privacy Policy. Key points:

• Data is encrypted in transit and at rest
• We do not sell or share your personal/business data
• You may export or delete your data at any time

10. Third-Party Services

The App integrates with:

• Google (OAuth, Firebase)
• Apple (App Store, subscriptions)
• RevenueCat (subscription analytics)
• Microsoft Azure Vision API (AI Color Analysis)

Your use of those services is subject to their own terms.

11. Disclaimers & Limitations

11.2 Accuracy

All data entry and color matches are your responsibility. Always verify critical information independently.

11.3 Business Advice

Not a substitute for professional advice (legal, financial, design). Consult qualified experts for business-critical decisions.

11.4 AI Color Analysis

Offered for convenience; may be imprecise due to lighting, device quality, and other factors. We are not liable for costs or losses from AI inaccuracies.

12. Liability Cap

To the maximum extent allowed by law:

• Our total liability is limited to fees you paid in the prior 12 months
• We are not liable for indirect, special, or consequential damages

13. Indemnification

You agree to hold us harmless from claims arising from your use of the App, violation of these Terms, or your data.

14. Termination

14.1 By You

• Cancel in-app; access continues until period end
• Export data before deletion
• Data deleted 30 days after termination

14.2 By Us

We may suspend or terminate accounts for violations, fraud, non-payment, or abuse.

15. Changes to Terms

We may update these Terms. Notice via in-app alerts, email, or webpage updates. Continued use means acceptance.

16. Governing Law

Governed by U.S. law and the state of You&Me Solutions’ primary place of business, without conflict-of-law rules.

17. Dispute Resolution

17.2 Jury Waiver

Both parties waive any right to jury trial.

17.3 Arbitration

Unresolved disputes go to binding arbitration under applicable rules.

18. Severability

If any provision is invalid, the rest remain in effect.

19. Entire Agreement

These Terms and our Privacy Policy constitute the full agreement.

20. Force Majeure

We are not liable for delays caused by events beyond our control, including third-party outages, disasters, or regulatory actions.
